These Terms and Conditions (“Terms”) apply to any skincare products (“Products”) that are provided by Genaura Limited (“Genaura”) as a gift (including samples) (“Gifted Products”) to individuals (“Recipients”). By accepting a Gifted Product, you agree to be bound by these Terms.

1. Eligibility

• • Gifted Products are provided at the sole discretion of Genaura
  • Genaura reserves the right to determine eligibility for receiving Gifted Products.

2. Purpose of Gifted Products

• • Gifted Products are provided for personal use only.
  • Gifted Products are not provided for commercial purposes, resale, or distribution.

3. Prohibition on Resale

• • Recipients must not (through themselves or through others) sell, resell, auction, or otherwise transfer Gifted Products in exchange for money or any other consideration.
  • Any resale of Gifted Products without the prior written consent of Genaura is strictly prohibited and may constitute a breach of intellectual property rights, trade mark rights, or unfair commercial practices.
  • Genaura reserves the right to take appropriate action (including legal action) to prevent unauthorised resale of Gifted Products.

4. Enforcement

• • Genaura reserves the right to take appropriate action if a Recipient breaches these Terms, including but not limited to:
    • Cancelling any future eligibility for receiving Gifted Products, promotional offers, or participation in marketing campaigns;
    • Requesting the immediate cessation of unauthorised resale activities;
    • Seeking reimbursement for any losses, damages, or costs (including reasonable legal fees) incurred as a result of the breach;
    • Taking legal action to protect its rights and prevent further unauthorised resale

5. Product Information and Safety

• • Recipients are responsible for reviewing the ingredient list and usage instructions prior to using the Gifted Products.
  • Genaura accepts no liability for adverse reactions resulting from failure to follow the recommended usage instructions.
  • Always review the full ingredients list and conduct a patch test before first use. If irritation occurs, discontinue use and seek medical advice.
  • Consult your doctor before use if you are pregnant, breastfeeding, taking medication or have a pre-existing medical condition.
  • Gifted Products may have a limited shelf life and should be used before the expiry date indicated on the packaging.
  • Gifted Products are formulated for cosmetic purposes only. They are not intended to diagnose, treat, cure or prevent any disease.

6. No Exchange, Return, or Refund

• • Gifted Products are provided free of charge and cannot be returned, exchanged, or refunded.

7. Limitation of Liability

• • Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.
  • To the fullest extent permitted by law, Genaura shall not be liable for any loss, damage, or expense arising out of the use or misuse of Gifted Products.

8. Governing Law

• • These Terms shall be governed by and construed in accordance with the laws of England and Wales.
  • Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
